§ 1 Scope of application
Any use of this website offered by MASS TIMBER SOLUTIONS GmbH ("MTS") ("MTS Website") or shopping on the MTS Website or the use of devices, products or services of MTS on the MTS Website ("MTS Services") is subject to these Terms of Use. These may be supplemented by additional terms and conditions (e.g. Data protection declarations, Imprint, General contractual conditions) may be extended or adapted. By using the MTS website, you accept these terms of use in their currently valid version.
§ 2 Contents of the MTS website
MTS provides information in text and image form on the MTS websites for information purposes.
MTS is entitled to discontinue the operation of the MTS website in whole or in part at any time. Due to the nature of the Internet and computer systems, MTS does not guarantee the uninterrupted availability of the MTS website.
§ 3 Registration, password
Individual areas of the MTS website may be password-protected in the interests of business security and therefore only accessible to registered users. There is no entitlement to registration. MTS is entitled to revoke access authorizations at any time by blocking access data without stating reasons, in particular if the user (i) has provided false information during registration or (ii) has violated these Terms of Use or statutory provisions when accessing or using the MTS Website or has not used the MTS Website for a period of more than 12 months.
Registration details must be truthful. Any subsequent changes to this information must be updated. Once you have registered, you will receive a user name and password ("user data"). The user data allows you to view and change the data you have provided or to revoke or extend your consent to data processing.
You shall ensure that your user data is not disclosed to third parties and shall be liable for orders placed under your user data and other chargeable or abusive activities. If you become aware or have a concrete suspicion that third parties are misusing your user data, you must inform MTS immediately.
You can request the deletion of your user data in writing at any time, provided that the deletion does not conflict with the processing of ongoing contractual relationships. In this case, MTS will delete your user data, in particular your stored personal data, provided that there are no legal provisions to the contrary.
§ 4 Data protection
When collecting, storing, using and processing your personal data, MTS complies with the applicable data protection regulations and the provisions of the Privacy policywhich can be viewed here.
§ 5 Rights of use and copyrights
All contents of the MTS website are protected by copyright, trademark or other legal rights. These rights must be observed. Trademarks and copyright notices may not be removed from the content provided.
Subject to your compliance with these Terms of Use, MTS and its content providers grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and make non-commercial use of the MTS Services. This license does not include any resale or commercial use of the MTS Services or its Content; any collection and use of product information, descriptions, or prices; any derivative use of the MTS Services or its Content; any downloading or copying of account information for the benefit of a third party; or any use of data mining, robots, or similar data gathering and extraction tools.
Notwithstanding the aforementioned provisions, information, brand names and other contents of the MTS website may not be changed, copied, reproduced, sold, rented, distributed, transferred, used, supplemented, altered, manipulated or distorted without the prior consent of MTS.
The user is not granted any rights other than those expressly named herein, in particular to the company name and to industrial property rights such as patents, utility models, content including the layout of the MTS website or trademarks.
If the user submits ideas and suggestions or uploads data on the MTS website, MTS may use and exploit these for the development, improvement and sale of its products and for training and analysis purposes free of charge and without restriction in terms of time, subject matter and territory.
§ 6 User behavior
You may not use the MTS website:
a) cause harm to persons and violate their dignity or personal rights;
b) violate common decency and customary manners with your usage behavior;
c) infringe industrial property rights, copyrights or other rights;
d) transmit or introduce malicious content, e.g. with viruses, Trojan horses or other programs that can damage IT systems;
e) enter, save or send hyperlinks or other content for which you are not authorized, in particular if these hyperlinks or content are subject to confidentiality, confidential or illegal, and
f) disseminate advertising, unsolicited or harassing e-mails (spam) or inaccurate warnings of viruses (hoax) or similar or encourage participation in competitions and similar promotions.
§ 7 Links to other websites
The MTS website may contain links ("hyperlinks") to third-party websites. Their use is at the user's own risk. MTS has no influence on the content of third-party websites and accepts no responsibility for data protection, data security or the content of such third-party websites, nor does MTS adopt these websites and their content as its own. However, MTS will follow up on your information and, if necessary, remove an external hyperlink from the content of the MTS website if it conflicts with these terms of use or applicable law.
§ 8 House rules
In order to comply with legal obligations or to avert imminent damage to MTS, MTS may, if necessary, delete posted content without prior notice, restrict access to it in whole or in part or move it to another area of the MTS website.
MTS reserves the right to block access to the MTS website permanently or temporarily, in particular in the event of recurring violations of these terms of use by users. MTS reserves the right to take legal - including criminal - action in the event of violations of the law and/or these Terms of Use.
§ 9 Liability
MTS provides correct and complete information on the MTS website within reasonable limits. Insofar as information is provided free of charge, liability is excluded, in particular for its correctness, up-to-dateness, accuracy, completeness, freedom from third-party property rights and copyrights and/or usability - except in cases of intent or fraudulent intent.
Liability on the part of MTS is excluded, unless liability is mandatory, e.g. under the Product Liability Act, due to intent, gross negligence and regardless of the degree of fault in the case of guarantees and warranties, due to injury to life, limb or health, due to fraudulent concealment or a defect. However, compensation shall be limited to the foreseeable damage typical of the contract, except in cases of intent or gross negligence.
MTS always endeavors to keep the MTS website free of viruses. However, MTS cannot guarantee that it is virus-free. Before downloading press material, you should therefore ensure that appropriate security measures and virus scanners are in place on the systems you use, also for your own protection.
§ 10 Validity and responsibility for content
The present version of these Terms of Use shall enter into force on 01.04.2024 and shall apply until a more recent version enters into force. MTS reserves the right to make and publish changes or additions to these Terms of Use without prior notice.

§ 11 Choice of law and place of jurisdiction
These terms of use are subject exclusively to the law of the Federal Republic of Germany. The UN Convention on Contracts for the International Sale of Goods (CISG) does not apply.
If the user is a merchant within the meaning of the German Commercial Code, a legal entity under public law or a special fund under public law, the exclusive - also international - place of jurisdiction for all disputes arising from and in connection with these Terms of Use shall be the Munich I Regional Court.
Mandatory statutory provisions, in particular regarding exclusive places of jurisdiction, remain unaffected.
§ 12 Final provisions
If contractual provisions including these Terms of Use do not become part of the contract in whole or in part or are void, invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
If these Terms of Use prove to be incomplete for reasons other than those stated in paragraph (1) (in particular due to the absence of provisions, for example due to overlooking points requiring regulation), the parties shall agree effective provisions in this respect - subject to the possibility and priority of a supplementary interpretation of the contract - which come as close as possible to the economic objectives of the contract.
All amendments, supplements and ancillary agreements between MTS and the user must be made in writing to be effective. This also applies to any agreement to deviate from this written form requirement.
